Welcome to Failscool. The terms “we”, “us” and “our” refer to Failscool. Failscool operates this store and website, including all related information, content, features, tools, products and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”), together with the policies referenced here, describe your rights and responsibilities when you use the Services. Please read these Terms carefully as they include important information about your legal rights (e.g., warranty disclaimers and limitations of liability).

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy PolicyAttachment.png. If you do not agree, do not use or access the Services.


 

1. Access and Account

You represent that you are at least the age of majority in your jurisdiction and, where applicable, you consent to the use of the Services by your minor dependents on devices you own or manage. You may be asked to provide information (email, billing, payment, shipping). You warrant it is accurate and that you have the rights to provide it. You are responsible for safeguarding your credentials and all activity under your account. You may not transfer, sell, assign, or license your account.

2. Our Products

We aim to describe products accurately, but colors/appearance can vary by device and settings. Descriptions, features, and availability may change without notice. We may discontinue products or limit quantities at our discretion.

3. Orders

When you place an order, you make an offer to purchase. Failscool may accept or decline any order at its discretion. We must receive and process your payment before acceptance. If we do not accept, change, or cancel an order, we’ll attempt to notify you via the contact details provided at checkout. Your purchases are subject to our Return & Refund PolicyAttachment.png. You represent your purchases are for personal/household use and not for resale or export.

4. Prices and Billing

Prices, discounts, and promotions may change without notice. The price charged is the price in effect at the time of order and appears in your confirmation email. Unless expressly stated, prices exclude taxes, duties, shipping, and handling. You agree to provide current and accurate payment information and authorize charges for your order (including applicable taxes/fees).

5. Shipping and Delivery

Processing and delivery times are estimates, not guarantees. We are not responsible for delays caused by carriers, customs, or events outside our control. Title and risk of loss pass to you when we hand the order to the carrier. See our Shipping PolicyAttachment.png

6. Intellectual Property

All content, designs, logos, and materials on the Services are owned by Failscool or its licensors and protected by applicable laws. You may use the Services for personal, non-commercial use only. No rights are granted except as expressly stated. Unauthorized use may violate intellectual property laws.

7. Optional Tools

We may provide access to third-party tools “as is” and “as available,” without warranties or endorsement. Use is at your own risk and subject to third-party terms.

8. Third-Party Links

The Services may link to third-party sites or content. We are not responsible for their content, policies, or practices. Review third-party terms before engaging in transactions with them.

9. Relationship with Shopify

Our store is powered by Shopify, but your purchases are with Failscool. Shopify is not responsible for sales or issues arising from your transactions with Failscool. You expressly release Shopify and its affiliates from claims related to your purchases with Failscool.

10. Privacy

Personal information is processed per our Privacy PolicyAttachment.png and Shopify’s policies. Because the Services are hosted by Shopify, certain data about your access/use is processed by Shopify and service providers (which may be located outside your country).

 

11. Feedback

If you submit reviews, ideas, or feedback (“Feedback”), you grant us a worldwide, sublicensable, royalty-free license to use and display such Feedback. You warrant you own the Feedback and it doesn’t infringe others’ rights.

12. Errors and Omissions

We may correct errors (including pricing, availability, or descriptions) and cancel affected orders, even after submission.

13. Prohibited Uses

Do not use the Services unlawfully or to infringe rights, transmit harmful code, harvest data, spam, or interfere with security. We may suspend or terminate access for violations.

14. Termination

We may suspend or terminate the Services at any time. Sections that by nature should survive termination do so (e.g., IP, disclaimers, liability, indemnity).

15. Disclaimer of Warranties

Except as required by law, the Services and products are provided “as is” and “as available,” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, and non-infringement). We do not guarantee uninterrupted or error-free use.

16. Limitation of Liability

To the fullest extent permitted by law, Failscool and its affiliates will not be liable for indirect, incidental, special, consequential, punitive, or similar damages (including lost profits, revenue, data, or goodwill) arising from your use of the Services or products.

17. Indemnification

You agree to indemnify and hold harmless Failscool, Shopify, and their affiliates and personnel from claims and expenses arising from your breach of these Terms, violation of law, or misuse of the Services.

18. Severability; Waiver; Entire Agreement

If any provision is unenforceable, the remainder remains effective. Our failure to enforce a right is not a waiver. These Terms plus referenced policies are the entire agreement.

19. Assignment

You may not assign these Terms without our consent. We may assign them without notice.

20. Governing Law & Jurisdiction

These Terms are governed by the laws of the Czech Republic. You agree to the exclusive jurisdiction of the courts of the Czech Republic.

21. Changes to Terms

We may update these Terms by posting a new version with an effective date. Your continued use after changes constitutes acceptance.
